Terms of Service

By registering an account, staking on a market, or otherwise using BantabaMarkets, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and our Regulatory Disclosure. These three documents together form the full agreement between you and us.

To use BantabaMarkets, you must:

• Be at least 18 years old;
• Have the legal capacity to enter into a binding agreement under the laws that apply to you;
• Be located in a jurisdiction where use of BantabaMarkets is not prohibited by local law: currently we intend the platform for users in The Gambia and Senegal, and we may restrict access from other jurisdictions at our discretion;
• Not be barred from using the platform under any prior suspension by us; and
• Provide accurate, current information when registering and when completing any identity verification we require.

It is your responsibility to determine whether using BantabaMarkets is lawful where you are located. We may ask you to verify your age and identity at any time, and may restrict or close your account if we cannot confirm your eligibility.

BantabaMarkets is a community prediction-pooling platform. Users stake an amount behind an outcome to a real-world, verifiable question; everyone staking the same outcome shares a common pool; and once the outcome is known, the pool is settled and divided among the winning side, minus a disclosed commission.

BantabaMarkets is explicitly not:

• a casino or a game of chance where the house sets odds against you;
• a continuous-trading exchange, contract-for-difference, or securities product;
• a source of investment, financial, or legal advice; and
• a guarantee of any particular return: all staking carries the risk of losing the full amount staked.

You must register using accurate information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at contact@bantabamarkets.com if you suspect unauthorized access.

Each person may hold only one account. We may require identity verification (“KYC”) before you can deposit or withdraw funds, and we may decline to open, or may suspend, an account that fails verification.

Your wallet has an available balance (funds you can stake or withdraw) and a locked balance (funds committed to open positions). When you place a stake, the amount moves from available to locked and cannot be withdrawn, cancelled, or cashed out early. Your position is held until the market resolves, except where a market is cancelled or voided by us (see Section 8).

Each market discloses, before you stake, its resolution criteria and the public source that will be used to determine the outcome. Once a market closes to new stakes, no further stakes are accepted on it.

When a market resolves, a commission of between 5% and 10% of the total pool (the exact rate is shown on the market) is deducted, and the remaining pool is distributed among winning positions in proportion to the size of each stake relative to the total winning stake. If you staked the losing outcome, your stake is not returned.

Deposits and withdrawals are processed through supported mobile money channels and payment partners. We may set minimum and maximum transaction amounts, apply processing fees (disclosed before you confirm a transaction), and take reasonable time to process a request.

We may delay, decline, or reverse a deposit or withdrawal, or request additional verification, where we reasonably suspect fraud, money laundering, a breach of these Terms, or where required by a payment partner or applicable law. Real-money staking is subject to the status described in our Regulatory Disclosure, which you should read before depositing funds.

You agree not to:

• open or use more than one account, or use another person's account;
• manipulate, or attempt to manipulate, a market's outcome, resolution source, or pool (including collusion with other users);
• use bots, scripts, or automation to interact with the platform without our written permission;
• deposit, stake, or withdraw funds derived from illegal activity, or otherwise use the platform to launder money or finance illegal activity;
• misrepresent your identity, age, or eligibility;
• interfere with the platform's operation, probe its security, or access data or accounts you are not authorized to access; or
• use the platform for any unlawful purpose.

Violating this section may result in suspension or termination of your account, forfeiture of implicated stakes, withholding of funds pending investigation, and, where required by law, reporting to the relevant authorities.

An authorized administrator resolves each market against its published resolution source and criteria, in good faith. If you believe a market was resolved incorrectly, you may raise a dispute by emailing contact@bantabamarkets.com within 7 days of settlement, explaining the basis for your dispute and, where possible, citing the published resolution source. We will review disputes raised in good faith; our decision following that review is final.

We may cancel or void a market, for example, where the resolution source becomes unavailable, the underlying event does not occur, or the market question turns out to be ambiguous or defective. In that case, all stakes on that market are refunded to participants' available balances, without commission.

BantabaMarkets is for users 18 and over. We encourage you to stake only what you can afford to lose, and to treat any winnings as uncertain until a market actually resolves. If you feel your use of the platform is becoming harmful, you may request that we suspend or self-exclude your account by contacting contact@bantabamarkets.com. We may also suspend an account on our own initiative where we reasonably believe this is necessary to protect a user.

The BantabaMarkets name, logo, platform design, and underlying software are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to access and use the platform for your own personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, or create derivative works from the platform without our written permission.

Content you post on the platform (for example, comments on a market) remains yours, but by posting it you grant us a non-exclusive, royalty-free license to display, reproduce, and distribute it within the platform. You are solely responsible for content you post, and must not post anything unlawful, defamatory, or infringing.

We rely on third parties to operate BantabaMarkets, including payment processors for mobile money transactions, cloud hosting and infrastructure providers, and, once active, a licensed gaming operator partner. We are not responsible for outages, errors, or failures caused by these third parties that are beyond our reasonable control, though we will act in good faith to resolve issues affecting you.

BantabaMarkets is provided “as is” and “as available.” We do not guarantee that the platform will be uninterrupted, error-free, or secure, or that any particular market, resolution source, or payout will be available or accurate at any given time. Resolution sources are external to us and may themselves be delayed, incomplete, or incorrect; we resolve markets based on a good-faith reading of the best available information at the time.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent permitted by applicable law, BantabaMarkets and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the platform. Our total liability to you for any claim arising from these Terms or your use of BantabaMarkets will not exceed the total amount you staked on the platform in the 3 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or for death or personal injury caused by our negligence.

You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the platform, or your violation of any law or the rights of a third party.

We may suspend or terminate your account, and decline pending withdrawals, if we reasonably believe you have breached these Terms, engaged in fraud or prohibited conduct, or if required to do so by a payment partner, regulator, or applicable law. We will make reasonable efforts to return any available (unlocked) balance owed to you, subject to completing any required verification.

You may close your account at any time by contacting us. Available balances will be returned subject to standard withdrawal processing and verification requirements.

We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date. Continued use of BantabaMarkets after a change takes effect means you accept the updated Terms. If a change is material, we will make reasonable efforts to notify you in advance.

These Terms are governed by the laws of The Gambia, without regard to conflict-of-law principles. If a dispute arises, we ask that you first contact us at contact@bantabamarkets.com so we can try to resolve it informally. If we cannot resolve a dispute informally, it will be subject to the exclusive jurisdiction of the courts of The Gambia.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. These Terms, together with our Privacy Policy and Regulatory Disclosure, are the entire agreement between you and us regarding BantabaMarkets, and supersede any prior agreement on the same subject.
